OUR UNIVERSE

Century XX marks a milestone in the history of the humankind.
It is the century of the lights, is the century of the conquest of the deep space.

After centuries of existence in this cosmic island and after a no lesser evolution of the human thought man obtains, by means of logical-mathematics abstractions, to rationalize his universe, to position himself in his cosmic surroundings, to reach the celestial bodies, to unravel the mystery of the creation of the universe and, in its big accelerator of particles called synchrotron, to create matter from the bombardment of the atoms of hydrogen, emulating the Creator, completely fulfilling the Biblical expression, paraphrased, "YE ARE GODS, ALTHOUGH YE HAVE FORGOTTEN". Sal.82.6 (Saint John 10.31-34)

GENESIS

The space neither the time were and it was the BEING in the Nature a cosmic singularity, to the power of 0, mathematically, (1)°=1, joined by empathy, whose auto-perception generated the NOUS.

The unitary continuity simultaneously allowed the formation of space and time, exploding when reaching the square of its ninth unit, repeating itself successively; mathematically (111,111,111) ² =12345678987654321, generating therefore the principle of Creation and Destruction, Eros and Tanato, Jehovah and satan. (The word satan -lowercase-, in Hebrew, means adversary. It is not the name of a supernatural evil force).

In the first second of the great creationist explosion our universe was of a diameter of approximately 10 centimeters.

Suddendly, enormous amounts of energy were freed, from which it was generated heat, antimatter and matter, along with everything that, today, we can appreciate in the universe.

All the secret lays in the disintegration of the atom of hydrogen, vital element of life in the universe.

In these so small residues lays all the galaxies of our universe, after which a super force dominated the universe.

By the cooling suffered, the super force divided itself, step by step, in the four well-known forces: the electromagnetic, the weak nuclear, the strong nuclear and the gravitational force, speculating with a fifth: the hyper charge.

This great explosion incidentally allowed the formation of our universe, compprised of around 100 billion galaxies and a similar number of stars, being these the number of neurons that comprises our brain.

One of these galaxies receives the name of Milky Way: a luminous star strip, drawn in the nocturnal sky, is in fact a spiral nebula in the form of a disc, comprised of about one hundred billion stars.

One of those stars is our sun, center of our planetary system, located at a side of the galaxy, far from the center and around which the planets of the Solar System revolves, being the Earth the third and known as the water planet, because it is composed of ¾ parts of water, essential element of life in the universe.

Nature guarantees the human reproduction. When a birth takes place the creature has a primary necessity of oxygen to live. In sequence, his high-priority is of oxygen, liquid and food.

The water is chemically composed of 2 atoms of hydrogen and one of oxygen. The life in all its forms and species would not exists without the presence of the atom of hydrogen, classified as the number 1 element in nature.

Hydrogen makes possible that all living cells are maintained through a series of chemical reactions that involves complex structures like those of the DNA (Deoxyribonucleic Acid) and proteins.

The most common substance in which the union of hydrogen takes place is in ordinary water, which responds to the chemical formula H2O, being the atoms of hydrogen our connection with the universe, where they take place in massive form, occupying 92% of the space, in which the sun is nothing but another star.

It is inconceivable that in a so vast space, as is it the universe, this is the only planet with a varied form of life,

where dwells a race of beings with cognoscible and manipulative capacity, in possession of intelligence and an advanced technology, with capacity of interstellar communication.

discussing Fascism versus Socialism, as I quote below.

Well, as a last try I will explain "Fascism For Dummies":First of all Fascism and socialism are NOT the same thing. In other words the gumment owns all industry and utilities and under the most extreme forms of socialism even the shops and small businesses.

Fascism on the other hand is when the powerful and well connected capitalists make a deal with thugs to run a country. The thugs get to pursue dangerous nationalism, militarize a nation, invade neighbors, and install some kind of racial or nationalist ideology that scapegoats a subgroup ( like Jews and socialists). Industry on the other hand gets a government that protects their interests by outlawing unions and strikes, feeds them very profitable contracts (most pointedly military contracts), and outlaws political parties that favor the workers ( LIKE SOCIALISTS).

Next, government collection of social insurance and dispersal of benefits is NOT socialism. Otto von Bismarck started the first social welfare programs in Germany during his governance as chancellor in the late 1800s. No one can call hard nosed Otto a "socialist". His program was a means to quiet workers demands by using "liberalism" to provide for the wants and needs of the vast majority of the population.

So to summarize: Socialism is the ownership of the means of production by the state ( this does not include the use of public money to TEMPORARILY prop up failed capitalists - THAT is fascism!). Fascism is the devil's deal between capitalists and thugs to give each what they want: profits for the capitalists and some insane ideology for the fascists. So the next time you see someone waving a poster of Obama as Hitler ask them if cats are dogs and if they bark!"

I found the subject interesting and well presented and contributed commenting as follows.

Now that we are, conceptually, in agreement in reference to the subject matter I will ask permission to divert your attention to the real root of this fierce opposition to any kind of reform to the health care system. MONEY

It is all about money and many of these "common people" disrupting town hall meetings and any kind of educative forum are, in one way or another, participants with the industry in a mayor scam to the Medicare-Medicaid and Food Stamp programs.

Rally "Standing with Obama on Public Health Care" at Senator Bill Nelson turns rowdy

A rally called to support a public healthcare option outside Sen. Bill Nelson's Coral Gables office quickly turned into a cross-street chanting and shouting match Thursday afternoon between about 250 backers and opponents.

The rally, organized by the liberal MoveOn.org, generated the latest in a string of heated and emotional public exchanges about healthcare reform, after opponents of the measures working their way through Congress also showed up.

Dave Patlak, a MoveOn.org volunteer who hosted the rally, said citizens had gathered to ask Nelson, D-Fla., to support a public healthcare option.
``It's the only real way to keep the insurance companies honest,'' Patlak said.

MoveOn attracted about 100 supporters of the public option, some of whom came with stories about health insurance nightmares.

Gary DeMaria, a construction manager who has been laid off three times in the past decade, said he was uninsured and afraid to get sick.
``Every time I got laid off, no health insurance,'' he said.
Opponents voiced fears about what might happen if the federal government were to take on a major role in providing healthcare.

Marcos Sendon, editor and president of SFlaConservative.com, who organized the group of about 150 opponents of a public health insurance option, said there were better, more efficient ways to make health insurance more affordable, including tort reform.

Much of the debate Thursday was drowned out by chants, car horns and, at one point, the singing of the national anthem.

Opponents chanted ``Obama is a liar!'' and ``No Obamacare!'' across Salzedo Street toward placard-wielding supporters, who shouted back ``Facts not fear!''

About a dozen Coral Gables police officers were on the scene, which was often tense but never violent.
``We're very happy that our side is so controlled,'' said Patlak, of Miami Beach. ``There's so much confusion on the other side. They're only responding to visceral lies. The legislation is actually quite moderate.''

Nelson, who is a member of the Finance Committee, was not present.
``[Nelson] appreciates folks advocating for the best possible legislation on healthcare reform,'' his office said in a statement. ``In a nutshell, he wants what most everybody wants: to fix a broken system. He also wants to make sure we find a responsible way to pay for it.''

The healthcare debate, which has intensified at the grass-roots level at town hall meetings and rallies around the country this month, is set to continue in South Florida during Congress' August recess.

``This is only a small dress rehearsal,'' said Sendon, of Miami. ``We're hosting a massive tea party on Aug. 22 at Bird Road and 87th Avenue. We'll have an incredible turnout then.''

Fighting the Smears on Health Care Reform

I read a comment on this blog that prompted me to reply in the following terms:

You got that right, I stated, in reference his statement "....If this isn't the biggest dang propaganda blog I've ever seen...."

The past administration's propaganda machine lied and convinced the whole world to wage war against Irak under the premise of its “implication with 911 attack and its possession of weapon of mass destruction”, assertion that President Bush admitted was not true, when questioned by surprise by members of the media during a press conference.

This war was financed with money borrowed from Communist China guaranteed with our taxes, making Communist China one of the largest holder of our external debt.

Then, as a last stab before leaving office, President Bush promoted a $700 Billion bailout for Wall Street to cover for their mismanagement of the American people finance. When Congress showed some reluctance to this the owners of the world banking system crashed the stock market.

Republicans now are claiming that the passing of a Public Health Care Option (to provide all American with Health Care is part of a “socialist agenda of the Obama and the Democratic Party”.

The homeowners that got their houses foreclosured by the banks can attest that your lender has a right over your property, according with our capitalism system.

Seems to be that few American are asking themselves; what would happen if Communist China decides to "secure" its “investment” in America?
Under this scenario I believe we would bypass the socialism stage and would jump from capitalism to communism, “American style” of course.

The point is that while the Republicans pawned the American country to the Communist China the conservative America neither the big interests in Washington campaigned against it and warned of the fact that they were selling America to a foreign country, whose economic system is diametrically opposed to our and that has surpassed us to a degree that they are already putting in place a plan to replace the American dollar with their own currency in the international transactions.

Ask yourself why they are establishing their factory abroad, transferring their earning to Swiss banks and buying properties outside of United States?
The signs of a sinking ship are well known by saylors around the world.

In other words, the Republican administration blowed it up, financially, in favor of the wealthy and now they, along with some blue dog democrats, are opposing the legislative measures that can get the American nation out of the mess that they left of with, just to blame it on President Obama.
As Senator Jim Demint stated: "If we're able to stop Obama on [health care reform], it will be his Waterloo. It will break him and we will show that we can, along with the American people, begin to push those freedom solutions that work in every area of our society."

NOTE: AFTER READING THE BILL I HIGHTLIGHTED THE MOST INTERESTING PARTS WHICH I AM IN THE PROCESS OF RESEARCHING AND, TO COMPLETELY DISPEL ANY ISSUE ARISING OUT OF IT, I AM GOING TO REQUEST CLARIFICATION FROM OUR ELECTED OFFICIALS BY EMAIL AND IN PERSON, DURING MY SCHEDULED VISITS TO THEIR OFFICES.

Lie "Page 22: Mandates audits of all employers that self-insure!"
TRUTH: This is not an "audit," it's a study. Moreover, the bill states (pp. 22-23) that the report will "include any recommendations the Commissioner deems appropriate to ensure that the law does not provide incentives for small and mid-size employers to self-insure or create adverse selection in the risk pools of large group insurers and self-insured employers."

Lie "Page 29: Admission: your health care will be rationed!"
TRUTH: Page 29 continues to define the "essential benefits package" and discusses limits on what Americans will have to spend on health care under this minimum standard. In no way does this section stipulate the rationing of care.

Lie "Page 30: A government committee will decide what treatments and benefits you get (and, unlike an insurer, there will be no appeals process)"
TRUTH: Page 30 begins to describe the Health Benefits Advisory Committee which establishes certain minimum standards for health insurance plans. In no way does this committee deny treatments and benefits to Americans with health insurance.

Lie "Page 42: The 'Health Choices Commissioner' will decide health benefits for you. You will have no choice. None."
TRUTH: Page 42 begins to describe the Health Choices Commissioner's duties. The idea that this person will decide what benefits Americans receive is patently false, given that most Americans will keep their current plans under reform, and Americans within the exchange will have the choice of purchasing many different kinds of health plans. Rather, the Commissioner will establish minimum standards to protect Americans.

Lie "Page 50: All non-US citizens, illegal or not, will be provided with free healthcare services."
TRUTH: Pages 50-51 contain a provision stating that discrimination will not be allowed in the provision of health care services. Nowhere does the bill state that non-US citizens will be provided free health care services. The bill prohibits federal dollars from being used for undocumented immigrants.

Lie "Page 58: Every person will be issued a National ID Healthcard."
TRUTH: Page 58, in the context of a discussion of administrative standards, mentions that "determination of an individual's financial responsibility at the point of service and, to the extent possible, prior to service, including whether the individual is eligible for a specific service with a specific physician at a specific facility...may include utilization of a machine-readable health plan beneficiary identification card." In no way does the bill state that such a card would be national, or that it would be issued to every person, or that it would, in fact, be used at all.

Lie "Page 59: The federal government will have direct, real-time access to all individual bank accounts for electronic funds transfer."
TRUTH: Page 59 continues the discussion of administrative standards, and authorizes electronic transfers of money within the government. In no way does this provision grant the government access to individual bank accounts.

Lie "Page 65: Taxpayers will subsidize all union retiree and community organizer health plans (read: SEIU, UAW and ACORN)"
TRUTH: Here's what page 65 says: "Not later than 90 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall establish a temporary reinsurance program to provide reimbursement to assist participating employment-based plans with the cost of providing health benefits to retirees and to eligible spouses, surviving spouses and dependents of such retirees." No mention is made of unions or community organizations.

Lie "Page 72: All private healthcare plans must conform to government rules to participate in a Healthcare Exchange."
TRUTH: That's true! Plans have to have a minimum standard of benefits; that can offer other plans as well. But that's fair, isn't it? Private insurers can continue to operate outside the exchange if they wish - should the government establish no standards for the exchange? In that case, how could reform end insurance industry abuses and help to control costs?

Lie "Page 84: All private healthcare plans must participate in the Healthcare Exchange (i.e., total government control of private plans)"
TRUTH: This section says is that if private health care plans want to operate in the Exchange, they must provide a basic benefit package.

Lie "Page 91: Government mandates linguistic infrastructure for services; translation: illegal aliens"
TRUTH: Some American citizens are more comfortable speaking a language other than English, especially in a sensitive situation like a consultation with their doctor. This provision in no way opens the door for coverage of undocumented workers.

Lie "Page 95: The Government will pay ACORN and Americorps to sign up individuals for Government-run Health Care plan."
TRUTH: Page 95 makes no mention of ACORN and Americorps; all it says is that the Commissioner can conduct outreach to vulnerable populations, making them aware of their options.

Lie "Page 102: Those eligible for Medicaid will be automatically enrolled: you have no choice in the matter."
TRUTH: People who are eligible for Medicaid will not have to face the burdens of paperwork and other bureaucratic struggles. Far from depriving people of choice, this measure will ensure coverage.

Lie "Page 124: No company can sue the government for price-fixing. No 'judicial review' is permitted against the government monopoly. Put simply, private insurers will be crushed."
TRUTH: This section describes rate-setting under the public health insurance plan option, which will compete with private insurers, who can set their own rates. Because of inherent advantages like their established administrative and provider frameworks, private insurance companies will not be "crushed" by government competition.

Lie "Page 127: The AMA sold doctors out: the government will set wages."
TRUTH: The government will negotiate rates with providers under the public health insurance plan option. However, private insurers will continue to pay their own rates.

Lie "Page 145: An employer MUST auto-enroll employees into the government-run public plan. No alternatives."
TRUTH: This is simply not true. Employers with more than 20 employees aren't even eligible to participate in the exchange, let alone the public plan, until several years after the exchange launches in 2013. Moreover, no employer will be forced to participate in the public plan.

Lie "Page 146: Employers MUST pay healthcare bills for part-time employees AND their families."
TRUTH: Employers are required to pay some benefits for part-time employees on a basis proportional to what they pay for full-time employees. No language on this page or the next stipulates coverage for the families of part-time employees.

Lie "Page 149: Any employer with a payroll of $400K or more, who does not offer the public option, pays an 8% tax on payroll"
TRUTH: The payroll penalty applies to employers with payroll over $500,000 who does not provide insurance to their employees. The percentage for employers with payroll from $500,000 - $750,000 is 6%. Employers do not have to offer the public option to avoid this penalty, they can offer private insurance if they wish.

Lie "Page 150: Any employer with a payroll of $250K-400K or more, who does not offer the public option, pays a 2 to 6% tax on payroll"
TRUTH: This is false, see above.

Lie "Page 167: Any individual who doesn't' have acceptable healthcare (according to the government) will be taxed 2.5% of income."
TRUTH: Pages 167-173 detail what "acceptable health care" means (basically, insurance coverage) and also allow for many different kinds of exceptions to this rule.

Lie "Page 170: Any NON-RESIDENT alien is exempt from individual taxes (Americans will pay for them)."
TRUTH: Non-resident aliens do not have to pay the penalty for not having health insurance, nor will they receive federal assistance, because they are not required to purchase health insurance. They are not exempted from individual taxes generally.

Lie "Page 195: Officers and employees of Government Healthcare Bureaucracy will have access to ALL American financial and personal records."
TRUTH: This is a gross overstatement. For the purposes of determining affordability credits for Americans who need financial assistance in purchasing health insurance, employees of the Health Choices Administration will have access to tax information that the federal government already keeps. As is clearly stated on page 196, "Return information... may be used by officers and employees of the Health Choices Administration or such State-based health insurance exchange, as the case may be, only for the purposes of, and to the extent necessary in, establishing and verifying the appropriate amount of any affordability credit described in subtitle C of title II of the America's Affordable Health Choices Act of 2009 and providing for the repayment of any such credit which was in excess of such appropriate amount.''

Lie "Page 203: "The tax imposed under this section shall not be treated as tax." Yes, it really says that."
TRUTH: This quote is taken out of context, and is in fact referring to a calculation used in the bill. Full context of quote: "'(4) NOT TREATED AS TAX IMPOSED BY THIS CHAPTER FOR CERTAIN PURPOSES.-The tax imposed under this section shall not be treated as tax imposed by this chapter for purposes of determining the amount of any credit under this chapter or for purposes of section 55.''

Lie "Page 239: Bill will reduce physician services for Medicaid. Seniors and the poor most affected."
TRUTH: This section has nothing whatsoever to do with reducing services. It makes much needed changes to the way in which physician reimbursement is recalculated every year. The bill will, in fact, create much more opportunity for seniors and the poor to receive necessary care.

Lie "Page 241: Doctors: no matter what specialty you have, you'll all be paid the same (thanks, AMA!)"
TRUTH: Page 241 does not say this. Nowhere does it say this. It does say that physicians will be grouped into certain categories regardless of specialty. These categories merely determine if the physician is engaged in primarily therapeutic or preventative care.

Lie "Page 253: Government sets value of doctors' time, their professional judgment, etc."
TRUTH: There is no good response to this assertion as it appears to have been made up completely. The section deals with 'misvalued codes' meaning that the government is potentially not paying an acceptable rate for a specific service. This will allow the government to, for example, pay more for services that require more payment, such as high-overhead procedures. The author of these criticisms separately attacks the bill for paying the same rate to all doctors, then attacks again for paying different rates.

Lie "Page 265: Government mandates and controls productivity for private healthcare industries."
TRUTH: This section amends the Social Security Act to include productivity measures. There is no mandate or control of anything. This merely updates the way in which doctors and hospitals are paid through Medicare.

Lie "Page 268: Government regulates rental and purchase of power-driven wheelchairs."
TRUTH: This is simply not true. This slightly amends existing guidelines for payments for medical equipment, in this case power-driven wheelchairs. This section introduces no 'regulations' that are not in the Social Security Act.

Lie "Page 272: Cancer patients: welcome to the wonderful world of rationing!"
TRUTH: Overusage of the hot-button word "rationing" is a way to deflect attention away from the actual language of the bill and incite unjustified fear. This section only compares costs incurred by cancer hospitals to costs incurred by similar hospitals, and adjusts payments to reduce the possibility of fraud and abuse.

Lie "Page 280: Hospitals will be penalized for what the government deems preventable re-admissions."
TRUTH: This is almost correct. The section is one of the first efforts at targeting excessive readmissions. Excessive readmissions are physically and emotionally damaging to patients, while simultaneously putting them, and the health care system, in far more financial risk than is necessary. The American Hospital Association recommended reduced payments for avoidable readmission in testimony to Congress.

Lie "Page 298: Doctors: if you treat a patient during an initial admission that results in a readmission, you will be penalized by the government."
TRUTH: This is patently false. The section is about possible methods that the Secretary of Health and Human services might consider in order to address the growing problem of patient readmission. This section does not, in any way, create a penalty, nor does it even mandate policy. It merely provides examples of recourses that might be considered.

Lie "Page 317: Doctors: you are now prohibited from owning and investing in healthcare companies!"
TRUTH: This provision only limits Doctor's investments in health care facilities that they refer patients to. The effort to limit self-referral has been ongoing for many years as an effort to reduce fraud and abuse. This is, essentially, the medical community equivalent of insider trading. Limiting this incentive works to put the patient's health above all other considerations. Doctors remain free to engage in investment opportunities in areas that don't create a significant conflict of interest.

Lie "Page 318: Prohibition on hospital expansion. Hospitals cannot expand without government approval."
TRUTH: This section regulates physicians' investment in hospitals to make sure that physicians are not unfairly benefiting from their power to refer patients to hospitals they have a stake in. The section does not prohibit hospital expansion.

Lie "Page 321: Hospital expansion hinges on 'community' input: in other words, yet another payoff for ACORN."
TRUTH: In the ongoing effort to demonize community-based groups such as ACORN, every instance of the word "community" has become associated with that group's efforts. In reality, this provision allows for anyone to provide input. This includes homeowners, religious leaders, neighborhood groups, and others. There are no payoffs. There is no money exchanged in any way.

Lie "Page 335: Government mandates establishment of outcome-based measures: i.e., rationing."
TRUTH: This provision is included in order to allow the government to base payments on practices that work. Nowhere does it say health care will be rationed. The attempt to isolate what works and what does not work in Medicare Advantage plans only benefits the health care system in general.

Lie "Page 341: Government has authority to disqualify Medicare Advantage Plans, HMOs, etc."
TRUTH: The government can disqualify some Medicare Advantage Plans from receiving some additional payments, but only if those plans are not meeting necessary requirements.

Lie "Page 354: Government will restrict enrollment of SPECIAL NEEDS individuals."
TRUTH: This section only deals with how to handle special needs individuals who need to enroll outside of the open enrollment period. Almost every type of plan operates with open enrollment periods. This section does not create more restrictions.

Lie "Page 379: More bureaucracy: Telehealth Advisory Committee (healthcare by phone)."
TRUTH: This section merely expands existing Telehealth programs, which supplement but do not replace other health coverage, and provide a vital resource to Americans in rural and remote areas.

Lie "Page 425-430: More bureaucracy: Advance Care Planning Consult: Senior Citizens, assisted suicide, euthanasia?; Government will instruct and consult regarding living wills, durable powers of attorney, etc. Mandatory. Appears to lock in estate taxes ahead of time; Government provides approved list of end-of-life resources, guiding you in death; Government mandates program that orders end-of-life treatment; government dictates how your life ends; Advance Care Planning Consult will be used to dictate treatment as patient's health deteriorates. This can include an ORDER for end-of-life plans. An ORDER from the GOVERNMENT; Government will decide what level of treatments you may have at end-of-life."
TRUTH: All of these hysterical claims have been debunked elsewhere. HR3200 provides for the reimbursement of a voluntary session of end-of-life counseling with your physician once every five years. This in no way means the government will make decisions for patients or encourage doctor-assisted suicide. Counseling simply makes patients and their families aware of their options.

Lie "Page 469: Community-based Home Medical Services: more payoffs for ACORN."
TRUTH: ACORN is not a Community-Based Medical Home.

Lie "Page 472: Payments to Community-based organizations: more payoffs for ACORN."
TRUTH: This is clearly still referring to community health groups, not ACORN.

Lie "Page 489: Government will cover marriage and family therapy. Government intervenes in your marriage."
TRUTH: Covering marriage and family therapy, as many private insurance plans do, does not mean that the government "intervenes in your marriage." The types of individuals who are recognized as therapists are clearly defined on page 491; in brief, professionals only, not bureaucrats.

Lie "Page 494: Government will cover mental health services: defining, creating and rationing those services."
TRUTH: This section expands government coverage for mental health services under various government programs, and ensures that all mental health services will be offered by qualified professionals.

Richard Charman read a letter of Senator Nelson dated July 13, 2009, in reply to a petition letter delivered by him, on May 29, 2009, by request of MoveOn.Org. requesting the support of Public Option, in reference to the Health Care Bill being drafted by Congress, which will provide ALL American people with:
1.- Affordable (low cost) Health Care.
2.- Freedom of choice in selecting whether to keep their private insurance or to enroll with a government backed Public Insurance, and
3.- Quality of care and low cost generic medication that have the same properties and benefit of brand name, yet more expensive, medications.

These are the 3 core principles that conform President Obama envisioned Health Care request for America.

In his letter of reply Senator Bill Nelson stated "...I am working toward reforms that would make health insurance available to all Americans through an insurance exchange and would provide subsidies to those who cannot afford coverage."

Richard Charman stated that the position of Senator Nelson falls short of the 3 core principles outlined by President Obama on his request to Congress for a Public Option.

The participants rushed to sign the petitions requesting Senator Bill Nelson to support a strong Public Health Care Option, as soon as Dave Patlak, leader of MoveOn.Org, Miami Beach Council, made them available.

Reference: Request for a Community Service Center

Honorable President:

We, the Neighbors of Allapattah in Miami, supported your campaign for the presidency of the United of States of America by volunteering time and resources, sometimes digging deep in our pockets for the last dollar to donate for the success of your campaign for the presidency of the United States of America.

When Mr. Richard Charman came to us in representation of your campaign, talking about your message of hope, he offered nothing to us other than your word asking us to believe in our ability to change our lives and, that, if you were elected, he would request the creation of a Community Service Center, where we would be provided with the following support services:
1. Job Placement and related services.
2. Counseling on how to access city, county, state and federal’s programs/services available to other communities.
3. Referral to services provided by other local non-profit and governmental agencies.

We are aware that dated November 4, 2008, the aforementioned request has been taken by Mr. Richard Charman, Pro Se, to The United States District Court, Southern District of Florida, in the form of a lawsuit, in which your campaign and the Democratic Party are named as codefendants, among others. That case was assigned the Num. 08-23076-CIV-GOLD/MCALILEY and, upon the filing of his motion titled “PLAINTIFF’S MOTION FOR APPOINTMENT OF COUNSEL”, dated May 26, 2009, this case, as per Order of the Honorable Alan S. Gold, dated June 9, 2009, was referred to the “Volunteer Lawyers’ Project for the Southern District of Florida” for potential representation.

Mr. President, with all due respect to the above named co-defendants legal right to a “Defense”, we understand that the hiring and alignment of a combined army of 6 Law firms, 4 by Obama For America, Inc. (your campaign) and 2 by the Democratic Party, against a Pro Se litigant (once named “the super volunteer”) not only violate the spirit of your campaign but it is a monstrosity waste of resources that could be used for the betterment of our community, for which you would have our perpetual gratitude.

Mr. President, historically this community have been continuously deceived by many of our politicians with their electoral promises of progress and messages of hope which, once in office, they tend to forget until the electoral cycle is reinitiated.

We expect that this cycle will end with your election as the President of the most powerful nation on earth and that this so much needed Community Service Center will come to fruition with your intervention allowing us, at the same time, to accomplish the following:
a) To save the tax payers a considerable amount of money on a needless litigation associated with this request.
b) To save your campaign and the Democratic Party from a moral defeat.

We fully support the above mentioned claim and for this reason we are signing this petition, expecting that you, as a former community organizer, will fully support our request by ordering the allocation of all necessary resources for the creation of the referenced Community Service Center.

Wondering what I am up to?

Thank to the vote of a overwhelming majority of the American People that supported a campaign promising the implementation of legislative measures in areas such as: Deficit Reduction, Renewable Energy, Health Care Reform and Jobs Creation, that would benefit the American Nation as a whole, Democrats have a majority in the House of Representative and Congress with a clear mandate.

However, despite the fact that some responsible Republican Senators and House Representatives have pledged their vote in support of the above measures, after being elected to office, some “Blue Dogs Democrats” are flip flopping and cutting deals behind closed doors with lobbyists of the big interests in Washington, jeopardizing a unique opportunity of getting the country out of it present financial crisis.

I’ll expend 40 hours canvassing and 20 hours phone banking for “Health Care Reform for America NOW!” starting 7/20/2009 ending 7/30/2009 or until Congress announce the passing of a Strong Public Option Health Care Reform Bill, according with President Obama envisioned 3 core principles: 1. Dr. Carrasquillo is a Puerto Rican-born physician who was raised in the Bronx. He was a co-founder of Latinos for National Health Insurance, an organization which advocates a single-payer universal health care system for the United States. Here is a quote from an account of a 2008 presentation by Dr. Carrasquilo:

(Dr. Olveen) Carrasquillo said research done in 2003 had shown that a national health care plan that awarded insurance to all residents, documented or not, would save between $200 billion and $250 billion, but feels that despite studies and statistics that there are those who would rather pay more in order to exclude the undocumented rather than save on an inclusive plan.

"I think the most glaring issue is that most of the leading politicians are not willing to take on this issue," Carrasquillo said. "It's obvious that there's widespread public support. Over half the U.S. population supports this, and yet they don't want to talk about it, simply put, because they don't have the backbones to stand up to the insurance and pharmaceutical industry."

Dr. Carrasquillo recently moved to Miami from New York City, where he served as Director of the Center for Health of Urban Minorities, to become the Chief of the Department of General Internal Medicine at the University of Miami Medical School. He serves on the Advisory Committee on Minority Health to the Secretary of Health and Human Services. He is principal investigator of several large federal grants relating to minority health and health disparities, has published in leading journals, and has served in leadership roles in various professional organizations.

2. Bernd Wollschlaeger, MD, FAAFP, FASAM, President of the Dade County Medical Association.

Dr. Wollschlaeger is a Delegate to the American Medical Association, which favors an insurance-based solution to our health insurance crisis.

This Saturday, May 9, 2009, the Miami-Dade Democratic Hispanic Caucus hosted a “Delegate Registration breakfast meeting” at Versailles Restaurant, located at 3555 SW 8th Street, Miami, Florida.

Millie Herrera, immediate Past President of the Democratic Hispanic Caucus of Florida requested this meeting because, as she said “Every year the Florida Democratic Party must conduct a Convention or Conference – it is called a Convention on election years, and a Conference on non-election years. This year’s Conference is scheduled for October 9-11, 2009, at Lake Buena Vista, Florida. There are Delegate Selection Rules that have been approved by the FDP Executive Committee that have to be adhered to in order to qualify and be elected as a delegate to the Conference…” Adding “…It is the responsibility of the DEC Chairs, State Committeeman and State Committeewoman who represent the County DEC’s in the FDP Executive Committee to disseminate this information and ensure that their County DEC has a full delegation.” “This has not happened” she emphasized.

The importance of this meeting is because the deadline to turn over the required application, for those who want to serve as delegates to the State Conference, is May 11, 2009. Otherwise, the alternative mechanism is that the DEC of the respective Counties can appoint any delegate by sending their application to the FDP headquarters by certified mail not later than the midnight of May 25, 2009, which could lead to the disenfranchisement of some members of Party, whishing to participate. Daisy Black, DEC’s First Vice Chair and immediate past president of the Democratic Black Caucus of Florida provided detail information on this issue and on important related dates. Forms and loyalty of oath notarization services were also provided.

Millie Herrera introduced Attorney Lisa Lesperance, District 117 State Representative candidate for 2010.

Dear Democrats:

Every year the Florida Democratic Party must conduct a Convention or Conference – it is called a Convention on election years and a Conference on non-election years. This year’s Conference is scheduled for October 9-11, 2009, at Lake Buena Vista, Florida. There are Delegate Selection Rules that have been approved by the FDP Executive Committee that have to be adhered to in order to qualify and be elected as a delegate to the Conference. Attached is a copy of these rules. It is the responsibility of the DEC Chairs, State Committeeman and State Committeewoman who represent the County DEC’s in the FDP Executive Committee, to disseminate this information and ensure that their County DEC has a full delegation “…guided by the affirmative action goals and policies in all phases of the Delegate Selection Process in order that the process shall be open and free from all forms of discrimination.”
This has not happened.
Miami-Dade DEC is entitled to 115 delegates to the conference, at least 87 or 75% must be DEC members, and the rest can be registered Democrats non-DEC members. The Qualification rules for becoming a delegate state that “All interested candidates are required to file with their County Chair, Vice Chair, State Committeeman, or State Committeewoman between April 6 and May 11, 2009. Yes, you heard it right, before May 11, 2009, all applications for delegates to the 2009 FDP State Conference must be turned in to the Miami-Dade DEC, otherwise you will not be qualified as a delegate. We have until Monday, May 11, 2009, to turn in our application for Delegate to the 2009 FDP State Conference!
After this deadline, the DEC must certify “…that all candidates possess the necessary qualifications. A list of certified candidates, including names, addresses and telephone numbers must be sent to the Party Headquarters by midnight on May 25, 2009”, which means, our DEC has to verify that all applications come from registered Democrats and that non-DEC members have submitted a Loyalty Oath. (see attached). The certified applications must be sent by our DEC to the FDP Headquarters via certified mail before midnight of May 25, 2009.
“County Democratic Executive Committees are mandated to hold meetings for the purpose of electing Delegates between the dates of June 1 and July 3, 2009”. If there are more than 115 delegate applications, candidates for delegate can give speeches and electioneer before this vote is taken, otherwise the DEC will vote to elect all delegates, unless there is an objection to a particular candidate because of violations of loyalty oath, etc.
The FDP Delegate fees are $35 or $20 for students, and the DEC’s can add $15, BUT to do this it MUST be voted on by the DEC membership. The Delegate fees are not due until Delegate election (between June 1 and July 3). After the Delegate election, “County Chairs must collect the forms and total fees and send them by mail to the Party Headquarters no later than July 20, 2009”.
These are the rules by which we must abide. I have highlighted the most important aspects of the process, but please review the full document attached for more detailed information.
As a member of the FDP Central and Executive Committee, and the FDP Affirmative Action Committee, it is my duty to ensure that ALL Democrats are represented in official Party events and that we have a voice. Conferences and Conventions are official Florida Democratic Party events that afford us the opportunity to weigh in on issues, receive important information and training, meet our elected and statewide Party officials, and vote on Party platforms. These events invigorate grassroots activists like us to continue giving of our time and money to elect Democrats. Therefore, I urge all of you to take action TODAY, complete the attached Delegate Application form so that Miami-Dade County DEC has full representation of 115+ delegates (there are additional appointed delegates to ensure we meet affirmative action goals, please review the attached Rules).
Seeing that our DEC has not followed the mandated procedures for informing and actively recruiting Delegates for the 2009 FDP State Conference, I have asked our First Vice Chair Daisy Black to help us meet the May 11th, 2009, deadline. This Saturday, May 9, 2009, the Miami-Dade Democratic Hispanic Caucus is hosting a Delegate Registration breakfast meeting at Versailles Restaurant, 3555 SW 8th Street, Miami, Florida. First Vice Chair Daisy Black and Immediate Past President of the Democratic Black Caucus of Florida will provide us information, forms and notarization of loyalty oaths, as needed. We invite and welcome all Democrats to join us, DEC and non-DEC members, African Americans, Asian Americans, Haitian Americans, Hispanics, Whites and Others, to PLEASE complete and turn in your Delegate applications so we can be proudly represented at the Conference this October. The Downtown Bay Forum held a luncheon meeting on Wednesday, April 29, 2009 at 11:30 am at the Marriott Hotel, 1633 N. Bayshore Dr., Miami, Florida.

The topic: Stop Waste! Save Money! What's Wrong with Our Prisons???

Speakers: Carlos Martinez, Miami-Dade County Public Defender; Barney Bishop,
President, Associated Industries of Florida; Valerie Jackson, Executive Director, NJC Systems.

Moderator Helen Aguirre Ferre introduces herself to the attendants.

Carlos Martinez, Miami-Dade Public Defender spoke about the initiative to reform the prison system, in order to bring order and to reduce the cost of it administration.

Valerie Jackson, Director of NJC Systems, spoke about the need to allocate more resources for diversion programs in benefit of those inmates that have a history of mental health and substance abuse problems in lieu of building more jails and prisons to house them.

Barney Bishop, President of Associated Industries, spoke about the efforts of the private sector in term of donating money to support said prison reform initiative and explained that they envision a reform where prisoners will have the opportunity to server part of their sentence in a prison with the opportunity of early release to a rehabilitation facility, where he will be given the opportunity of having a job in preparation for his reinsertion to the community.

Richard Charman, Director of Business Development of Net-Tronics.com, introduced himself as founder of IAM4OBAMA, Neighbors of Allapattah, whose aim is to enhance the lives of the residents of the neighborhood in every aspect.
He spoke in support the initiatives aforementioned and emphasized the need of reviewing the guidelines by which service providers receives federal, state and county funds making them accountable for them base on the clientele success story.

El pasado 24 de Abril del 2009 recibí una invitación de parte de Orlando Reyes (a quien aun no tengo el honor de conocer personalmente), para asistir a una conferencia a celebrarse en el Hotel Intercontinental West Miami, sito en la 2505 NW 87 Avenida, de la ciudad de Miami, Florida, titulada "Juan Bosch Siempre", auspiciada por El Consulado General de la Republica Dominicana, que tan dignamente representa el Honorable Cónsul Licdo. Manuel Almanzar Castillo, tal como fue publicado por el "Diario Las Américas" en su edición del 18 de Abril del corriente, a tenor con el articulo del brillante periodista Marco Antonio Ramos.
Alli, fui recibido afablemente por el Honorable Consul, y tuve la oportunidad de confraternizar con algunos compatriotas.

Con esta conferencia, el Consulado General de la Republica Dominicana en Miami dio inicio a un ciclo de conferencias conmemorativas del centenario aniversario de el insigne Presidente Constitucionalista dominicano Profesor Juan Bosch Gavino.

El conferencista invitado fue el ilustre Dr. Euclides Gutiérrez Félix, quien al igual que el actual Honorable Presidente de la Republica Dominicana Dr. Leonel Fernández Reyna, fue miembro del círculo intimo del finado Profesor Juan Bosch.

Fungió como maestro de ceremonias el Señor Virgilio García, quien, entre otras cosas, se desempeña como Director de Asuntos Comunitarios del Consulado Dominicano, siendo acompañado en la mesa de honor por el Vice Cónsul Amaury Ríos, Presidente de la seccional de la Florida del Partido de la Liberación Dominicana (P.L.D.), tal como se puede apreciar en la siguiente foto.

El Honorable Cónsul Licdo. Manuel Almanzar Castillo presento al Conferencista, a quien elogio por su capacidad literaria, así como por ser uno de los pilares del P.L.D., miembro fundador del segundo circulo de estudios, al cual pertenecio tambien el aguerrido insigne Dr. Jose Francisco Pena Gomez, conocido como el "Tribuno de Barricadas" por el encendido verbo del cual hizo gala notoriamente durante la gesta constitucionalista del 24 de Abril de 1965, el cual utilizo, posteriormente, durante su agitada y prolongada carrera politica como gusanillo con el cual incaba la piel moral de sus numerosos adversarios politicos.

“Otro noble Dominicano digno de emular”, expreso el Honorable Consul, antes de pedir un fuerte aplauso para el ilustre conferencista, procediendo a cederle el podium acto seguido.

El Dr. Euclides Gutiérrez Félix ciertamente desarmo a su audiencia desde el principio, mas que nada por su sencillez, oyéndose en ocasiones mas de una voz femenina halagándole, tal como la que se levanto alegremente sorprendida sobre la risa de los presentes, a pesar de su vano intento por emitir un susurro, diciendo “…hacia tiempo que no oía eso!!!”, refiriéndose ella, con la casta coquetería que suelen mostrar muchas mujeres dominicanas, a la alusión del conferencista en una de sus anécdotas, a una de las tantas “queridas” de Trujillo, al describirla en los siguientes terminos “…no era ella una mujer bella, hermosa, en el sentido de la palabra. Ella era una mujer bonita. UNA GALLINA DOMINICANA” acoto con un gesto inocente, lleno de picardía, el cual parece ser un rasgo intrínseco de su personalidad, mismo que afloro varias veces durante la noche, adornando con "matices felinos" su disertación (lo cual me permito decir, tomando licencia literaria).

Durante esta conferencia, interrumpida incontables veces por los aplausos de la audiencia, (véase fotos al pie del párrafo) el Dr. Gutiérrez Félix diserto sobre los temas "Monarca Sin Trono" y del "Dictador", temas centrales de uno de sus incontables libros puesto en circulación al final de la susodicha conferencia donde el autor hizo gala tanto de sus dotes de orador; de su prodigiosa memoria (considerando sus 72 anos); así como de lo que es mas importante aun, en el aspecto humano, de su don de gente, deleitándonos con múltiples anécdotas tanto de la vida publica y privada del Profesor Juan Bosch, así como de la del tristemente celebre "Excelentísimo Generalísimo Dr. Rafael Leonidas Trujillo Molina, Benemerito Benefactor y Padre de la Patria Nueva", como se autotitulo aquel tenebroso personaje quien gobernó a la Republica Dominicana con mano férrea por alrededor de 30 anos, muriendo por la misma ley por la que vivió.

Trujillo fue conocido también por muchos como "El Jefe", por otros como "El Papa de mi leche", en el exterior como "Chapita" o simplemente por el peyorativo de "El Chivo", mote endilgado por uno de sus mas acérrimos enemigos, cuya identidad parece haberse perdido en el inexorable devenir del tiempo pero cuyo espíritu ha trascendido al inspirar con ese mote a no pocos trabajadores de las distintas ramas del arte, dejándonos como recuerdo indeleble de aquella gesta histórica la pegajosa canción popular, escrita a ritmo de merengue, "La Muerte Del Chivo".

Otro ángulo del salón de conferencia muestra parte del numeroso publico que engalano con su presencia los salones dorados del susodicho hotel, entre el que se encontraban tanto dirigentes del Partido de la Liberación Dominicana así como también representantes de los diferentes segmentos de la población dominicana radicados, la mayoria, en el Sur de la Florida, interesados en el quehacer nacional.

Entre los asistentes podemos destacar la presencia de Jonathan D'Oleo,Economista; María Méndez, especialista en bienes raíces; Eusebio Sánchez, Profesor de Locución; Yunis Segura-McNally, Experimentada Agente de Viajes; Fidel Aquino, Maestro Diseñador; Arismendi Mateo y Dr. Kirby Reyes, (el dúo dinámico), entre otros.

Antes de finalizar la conferencia el Dr. Euclides Gutiérrez Félix juramento la Comisión encargada de coordinar las actividades conmemorativas del centenario aniversario del Profesor Juan Bosch, en el Sur de la Florida.

On January 11, 2009, across the country, over 4,000 MoveOn members gathered at local council facilities to discuss ideas on how to request congress representatives to support the Economic Recovery Plan of President Elect Obama.

We, the Miami-Beach council, were not the exception. With that idea in mind we developed a plan to collect signatures from the public to be delivered to our district congressmen/women, to show them and the media that there's overwhelming public support for investing in health care, green jobs and clean energy.

Lead by Dave Patlak, we started here, in Miami, Florida, by visiting the local offices of Ileana Ros-Lehtinen at 4969 SW 72nd Avenue Miami, FL 33155, last Wednesday, January 14, 2009, 12:00 PM.

Poema "Absurdo" escrito por Richard Charman en 1985, basado en una historia de amor de la vida real, sobre las relaciones de una pareja de profesionales: ella, una periodista de origen judio-americano, nacida en Islas Virgenes y el, un joven multifacetico nacido en la Republica Dominicana, ambos residentes de la Isla del Encanto, en aquel entonces.

Este video es la primera version video-grafica creada por Alicia Martinez, genial artista grafica oriunda de "La Tierra de Gardel" con la incomparable voz de Marcela Varela.

Actualmente este video es objeto de una disputa en los tribunales federales de la ciudad de Miami, Florida, en virtud de que fue ilegalmente apropiado por una persona a quien le fue confiada una copia con el proposito de ser reproducida para el levantamiento de fondos para la campana presidencial del Senador Obama.

Raul Martinez, candidato al Congreso de Estados Unidos, unico retador del actual congresista Lincoln Diaz-Balart por el distrito 21, endoso al Senador Obama desde sus oficinas de campana, sitas en la sede del Partido Democrata en la ciudad de Pinecrest, florida.

After the Meeting at the Intercontinental Hotel in Miami, I headed to the Rally for Obama in Sunrise, Florida.

Hoy 16 de Mayo, después del cierre de campana, en la Republica Dominicana, los dominicanos se preparan a decidir su destino político por los próximos 4 anos venideros. Pero esta vez, con estos aires, esta en juego mas que la llamada “Silla de Alfileres”, esta en juego el futuro de esta hermosa nación flagelada por la insensibilidad de ciertos politiqueros que ven en alcanzar tan alto puesto solo una oportunidad mas de enriquecerse a expensas del hambre y la miseria de la mayoria del pueblo dominicano.

No obstante, existe la esperanza de que el actual mandatario, Dr. Leonel Fernández Reyna, resulte reelecto porque el pueblo ha hecho suya la frase que hizo famosa su mentor "No se cambia de montura cuando se esta cruzando el rio.".
No es el ciertamente un “dechado de virtudes”, en el sentido estricto de la palabra, pero si es un gran ciudadano que ha demostrado que ama a su patria y siente conmiseración por los menos privilegiados, siendo tambien reconocido como un amigo leal, probado en situaciones escabrosas de la política latinoamericana.

Paladin de la Paz en la Cumbre de Rio, se destaco como lider internacional indiscutible. Miguel Vargas Maldonado, bajo investigacion por trafico de drogas, lavado de dinero y trafico de influencias (prevaricacion, de acuerdo con el articulo 26, a tenor con el acapite 4 del articulo 23, de la Constitucion), aspirar a la presidencia de la Republica Dominicana?(*) Presione aqui para ver el video. Mientras tanto sigue preso Antonio Martes, lider de CONATRA y fundador del llamado "Comando Nacional de Transporte Sector Externo Miguel Vargas Presidente", manejado en San Pedro de Macoris por sus testaferros, el taxista Rolando Benitez Cedano alias "El Vividor" y el abogado Remberto Ventura, alias "La Rata", quien mediante subterfugios "arreglo" la renta del local de la familia del Ingeniero Richard Charman, comerciante y ciudadano dominico-norteamericano, radicado en la ciudad de Miami, Florida. El abogado Rafael Arias, tel.(809)548-1610, se "encarga de pagar" la renta con sus cheques personales.

El Dr. Mariano Inirio Sanchez, fiscal de San Pedro de Macoris por mas de 20 anos, actualmente dedicado a la practica privada, Tel. Ofic. (809)246-3216, Celular (809)962-5166, es el representante legal del Ingeniero Richard Charman en la Republica Dominicana.

Una fuente de entero credito del (CIA-CPL) "Comando Internacional de Apoyo Candidatura Presidencial Leonel" manifesto, sobre las personas anteriormente mencionadas: "El tristemente celebre Antonio Marte, lider de CONATRA, acepto poner en marcha una estratagema politica del Ing. Valgas Maldonado, con el proposito de burlar la intencion de los votantes desafectos del Partido Revolucionario Dominicano (PRD) que bien pudieran votar por su candidatura, pero que se resistian a entrar a los locales del PRD. Se decidio formar el mencionado "comando" aprovechando la posicion de liderazgo del Senor Antonio Marte, presionado por una supuesta "deuda politica" contraida con la claque del PRD durante su pasado gobierno".

Es asi como el abogado Remberto Ventura, quien se valio de una vecina de la senora Delia Gumbs para ofrecer sus servicios como administrador del apartamento ubicado en los altos del edificio, sito en la Avenida Coronel Francisco Alberto Caamano Deno #117 esquina Prolongacion Rolando Martinez, firma un “contrato de representación” con esta senora, el pasado mes de Febrero del 2007, después de comprobar que el Ingeniero Richard Charman habia rehabilitado por completo los componentes del edificio y la residencia familiar.

El abogado Ventura se identifico como Diacono de la Iglesia Catolica, pero nunca informo de su afiliacion politica con el PRD ni de su relacion con el susodicho "Movimiento".

Posteriormente indico a los propietarios del inmueble, quienes por razon de enfermedad de la senora Delia Gumbs habian retornado a Miami, que este habia sido alquilado a una persona para "una oficina de transporte", sin divulgar los fines reales.

Poco tiempo despues, el Ingeniero Richard Charman recibio informes, de parte de sus asociados en San Pedro de Macorís, de que alli se habia instalado el mencionado "Comando" y de que habian hecho cambios sustanciales a la propiedad, incluyendo pero no limitandose a: borrar el letrero de la empresa Net-Tronics.com, Corporation del frente del edificio; pintar un letrero del "Movimiento" alrededor de el vuelo del edificio y posteriormente reemplazar el color naranja positivo, con que estaba recientemente pintado uniformemente el edificio, por un color amarillo canario, supuestamente representativo del "Movimiento".

Las violaciones no pararon ahi. El Ingeniero Richard Charman obtuvo fotografias que muestran como estos tenebrosos personajes habian conectado un cable desde la residencia de los propietarios, contigua al edificio, "robando" la electricidad por un extenso periodo de tiempo, lo cual solo termino cuando, alarmada por los informes, la senora Delia Gumbs viajo a la Republica Dominicana, pese a su enfermedad, y el abogado Remberto Ventura "La Rata" alego que ".....los inquilinos tienen derecho a hacer los cambios que consideren de lugar" y, admitio haberles dado permiso para que se conectaran al servicio electrico de la residencia.

Este comenzo a presionar a la Sra. Gumbs para hacer ciertos cambios a la estructura interna del edificio, supuestamente por demanda de los "inquilinos", a cuyos efectos convoco a una reunion en la que participarian el, "El Vididor" y la propietaria.

El Ingeniero Richard Charman contacto a dos abogados para que acompanaran a su madre en la susodicha reunion y relevaran sumariamente al "abogado del diablo" de la administracion de la propiedad. Entre ellos figuro la hermana de un abogado amigo, quien se desempena como alguacil y quienes son tambien vecinos de las partes implicadas.

Meses despues, siguientes al retorno de la senora Delia Gumbs a Miami para seguir tratamiento por su artritis cronica, el 14 de Febrero del 2008, uno de los testaferros en Miami del Ingeniero Vargas Maldonado, conocido como Javier Herrera, co-propietario del mini-mercado "Santa Ana Market", sito en el 3000 NW 12 Avenida, de Allapatah, intento asesinar al Ingeniero Richard Charman en su residencia, segun consta en el pliego acusatorio Num. F08-005781, apuntandole con un arma de fuego al tiempo que le decia "....yo a ti te voy a joder".

La reaccion rapida del Ingeniero Richard Charman frusto el intento de asesinato y el delincuente, quien nego los hechos asi como que poseyera arma alguna, fue esposado por la policia en su negocio, en donde despues de una exhaustiva busqueda se le confiscaron una pistola y una escopeta, ademas de un revolver que ocultaba entre el asiento trasero de la camioneta de su propiedad.

Todas las armas estaban completamente cargadas “.......como si se dirigiera a una guerra” observo uno de los policias que intervino en el incidente.

Tras leersele sus derechos constitucionales el individuo fue arrestado y conducido a la carcel del condado donde paso la noche, saliendo en libertad al otro dia tras prestar una fianza.

En una vista posterior fue instruido de cargos y la fiscalia (bajo el "Plea bargain estatute") le ofrecio 3 anos de carcel, probatoria y un ano de arresto domiciliario.

Bajo los consejos de su bruja, quien lo acompano a la vista, el imputado se declaro inocente y rechazo la oferta, mientras el Ingeniero Richard Charman observaba el cuadro un tanto divertido.

Durante una vista subsiguiente, el acusado se declaro "insolvente" y le fue asignado un abogado (pro bono) pagado por el Estado.

Como parte del proceso criminal incoado el tribunal, presidido por el Honorable juez ( ), pauto una vista para el dia 9 de Junio del 2008.

On July 19, 2008, as part of the Nationwide canvassing kickoff of the Democratic Party coordinated campaign, we organized a group to work for the neighborhood in an attempt to bring to the attention of running candidates the state of neglect that our sector has been subject to, for years.

The group was called "IAM4Obama, Neighbors of Allapattah in Miami".

During that meeting we discussed the problems of the community and agreed to bring these issues to the attention of our candidates for office, to seek from them to pledge to add these issues as part of their campaign, whenever is feasible. Also, we created a work-group of volunteers that will be help with all the tasks related with the coordinated campaign of Democratic Party aimed toward the Primary of August and the General Elections of November.

The issues selected to discuss during our next meeting were the following:
1.- Request from our candidates to come to our community to show them the level of abandonment that this community is in.

2.- Elderly and disabled -the problems associated with home assistance and the payment for services and equipment associated with their need.

3.- At Risk Youth and Children suspended from school -How to provide sound services to those children when suspended and sent home, absent their parents from home due to work responsibilities and the need of keep them current on school material covered and assignments.

4.- Job Security and alarming unemployment rate incremental in this community and the need of training program for workers.

5.- Problems with the processing of applications with Section 8 of the Housing program.

6.- Poor transportation (long waiting period and unprotected bus stop).

7.- Police targeting of honest residents and other abuses of authority.

8.- Patrolling increase during the late hours of the night in the neighborhood.

The following people participated in this meeting and pledged to bring more people to participate in the next meeting:

A Legal Aberration Called "At Will Statute"

I was writing about my intention of asking Senator Obama to add, as part of his campaign on behalf of the American workers, the abolishment of the “At Will Statute”, a legal aberration that has no place in a country that is facing the challenge of competing on a global economy against other countries with more advanced legislation on labor law matters and which, at the beginning of the 21rst century is positioned as a world potency.

I understand that this would be a revolutionary CHANGE that would provide Job Security to million of American Workers and that could enhance the employer/employee relationship.

As I decided to take a break by looking at some of the most popular blogs on myspace I posted a comment on one of the blogs that called my attention.

Later I got some replies showing interest on my writing and I decided to send a friend request to them, to make sure that I could reply to them, since I have the bad habit of losing track of my comments on others blogs (not a problem on mine since only a few souls bother to comment on it randomly).

The following is one of the most remarkable, as it is related to the issue that I am focused on.

I am a volunteer with the Obama's campaign and I am trying to seek the abolishment, nationwide, of the "At Will Statute".

According with the At Will Statute, In the United States of America, employees without a written employment contract generally can be fired for good cause, bad cause, or no cause at all; judicial exceptions to the rule seek to prevent wrongful terminations but in practice are hard to enforce by the fired employee, in struggle to survive the unexpected firing, in an environment highly influenced by the monetary power of the employer.

This Statute wrongfully assumes that both, employers and employees, has the same bargaining power to enter into an employment agreement.

Many workers in the United States believe that satisfactory job performance should be rewarded with, among other benefits, job security.

However, this expectation that employees will not be fired if they perform their jobs well has eroded in recent decades in the face of an increased incidence of mass layoffs, reductions in companies’ workforces, and job turnover.

In legal terms, though, since the last half of the 19th century, employment in each of the United States has been “at will,” or terminable by either the employer or employee for any reason whatsoever. The employment-at-will doctrine avows that, when an employee does not have a written employment contract and the term of employment is of indefinite duration, the employer can terminate the employee for good cause, bad cause, or no cause at all.

I want to make sure that the Obama’s administration will pass a bill to congress to create the “American National Standard Labor Act” that will get rid of the "At Will Statute" and will incorporate the exceptions as standards, adding basic Fringe Benefits to all employees since the first day of commencement of their function, regardless of their level of skills, such as:

The Accrual of Vacation and Sick leave, as follows:
1) 1 day and 1/4 of vacation accrued per month of employment, to be paid at the employee's current rate of payment after a calendar year of employment or at the time of his termination.

2) 1 day and 1/4 of sick leave accrued per month of employment, to be paid at the employee's current rate of payment after a calendar year of employment or at the time of his termination, not to exceed 24 months. (sick leave will be paid up to 15 days of continuous absence due to illness).

This is statutory in countries considered "third world countries".

An employer shouldn't be able to fire an employee without going though a process of mandatory arbitration, considering that he has all what it takes to screen the employee previous to his hiring, which is consistent with the assumption that when the employer exercised his educated judgment in the hiring he accepted the responsibility of his act.

I am going to write to Obama to seek his support. I believe that this will bring the majority of the middle class workers that were reluctant to give him their votes during the past primaries (This alone will satisfy the Demand for Change, voiced by the citizens and adopted by the Obama’s campaign)..

Passing this message to all friends and known political figures, especially legislators, will be crucial to spread the message beyond our personal boundaries.

I am a small business owner. I have been in business for a few years, and only keep 2 employees. I would never be able to afford these practices. Basically, this bill, if passed without provision, would price me right out of my livelihood, forcing me to look for work with someone else. Since many people are in the same coat as I, all that would leave would be jobs with large corporations.
So, where do you draw the line?

I would like to put in place the abolishment of the "At Will Statute" for all businesses in respect to firing without cause or for any other reason other than bad job performance and/or economic business hardship.

This bill will be known (proposed) as The American National Standard Labor Act (TANSLA), for short, and is intended to cover a broad range of employer/employee relationship.

The purpose is to enhance the national economy, in a global market, and to improve the employer/employee dynamic, considering the employer the main source of capital inflow in the live of employees. Therefore it will seek to motivate the establishment of new businesses of all sizes, to support the small business community (especially those businesses created by displaced employees due to any reason).

In the pursue of that objective exemptions to the "Fringe Benefits" aspect of this bill should be considered and should be based on the net income of the corporation or the individual (sole proprietor) rather than in the number of employees. (corrected 7/5/2008)

In my experience 15 days vacations and sick leave is reasonable and it will be the cap imposed by the bill narrowing it down to 10 days, 5 days paid vacations. I believe that any small business generating a net income up to $100, 000.00 should be exempt from this obligation, regardless of the nature of the business.

Basically, the spirit of the bill will be to create Job Security ensuring business stability.

This is a general idea and any input, based on personal experience and expectations, is very appreciated, to request a very realistic solution.

Traditionally and as recently as the early 1900s, courts viewed the relationship between employer and employee as being on equal footing in terms of bargaining power. Thus, the employment-at-will doctrine reflected the belief that people should be free to enter into employment contracts of a specified duration, but that no obligations attached to either employer or employee if a person was hired without such a contract.
Because employees were able to resign from positions they no longer cared to occupy, employers also were permitted to discharge employees at their whim.

The Industrial Revolution planted the seeds for the erosion of the employment-at-will doctrine.
When employees began forming unions, the collective bargaining agreements they subsequently negotiated with employers frequently had provisions in them that required just cause for adverse employment actions, as well as procedures for arbitrating employee grievances.

The 1960s marked the beginning of Federal legislative protections (including Title VII of the 1964 Civil Rights Act) from wrongful discharge based on race, religion, sex, age, and national origin.

These protections reflected the changing view of the relationship between employer and employee.

Rather than seeing the relationship as being on equal footing, courts and legislatures slowly began to recognize that employers frequently have structural and economic advantages when negotiating with potential or current employees.

The recognition of employment as being central to a person’s livelihood and well-being, coupled with the fear of being unable to protect a person’s livelihood from unjust termination, led to the development of common-law, or judicial, exceptions to the employment-at-will doctrine beginning in the late 1950s.

The bulk of the development of these exceptions did not take place until the 1980s, but as we enter the new millennium, the employment-at-will doctrine has been significantly eroded by statutory and common-law protections against wrongful discharge.

There are three major exceptions to the employment-at-will doctrine, as developed in common law, including recognition of these exceptions in the 50 States. These are:
1. Public-policy exception
Under the public-policy exception to employment at will, an employee is wrongfully discharged when the termination is against an explicit, well-established public policy of the State.
For example, in most States, an employer cannot terminate an employee for filing a workers’ compensation claim after being injured on the job, or for refusing to break the law at the request of the employer.

The majority view among States is that public policy may be found in either a State constitution,
Statute, or administrative rule, but some States have either restricted or expanded the doctrine beyond this bound.

The public-policy exception is the most widely accepted exception, recognized in 43 of the 50 States.

2. Implied-contract exception
The second major exception to the employment-at-will doctrine is applied when an implied contract is formed between an employer and employee, even though no express, written instrument regarding the employment relationship exists. Although employment is typically not governed by a contract, an employer may make oral or written representations to employees regarding job security or procedures that will be followed when adverse employment actions are taken. If so, these representations may create a contract for employment.
This exception is recognized in 38 of the 50 States.

3. Covenant-of-good-faith exception
Recognized by only 11 States (see map 3), the exception for a covenant of good faith and fair dealing represents the most significant departure from the traditional employment-at-will doctrine.34 Rather than narrowly prohibiting terminations based on public policy or an implied contract, this exception— at its broadest—reads a covenant of good faith and fair dealing into every employment relationship. It has been interpreted to mean either that employer personnel decisions are subject to a “just cause” standard or that terminations made in bad faith or motivated by malice are prohibited.
As with the public-policy exception, California courts were the first to recognize an implied covenant of good faith and fair dealing in the employment relationship. In Lawrence M. Cleary v. American Airlines, Inc.,36 an American Airlines employee who had worked satisfactorily for the company for 18 years was terminated without any reason given. A California appellate court held that, in virtue of the airline’s express policy of adjudicating personnel disputes and the longevity of the employee’s service, the employer could not fire the employee without good cause.
The court stated that “Termination of employment without legal cause after such a period of time offends the implied-in-law covenant of good faith and fair dealing” and that, from the covenant, “a duty arose on the part of...American Airlines…to do nothing which would deprive...the employee...of the benefits of the employment...having accrued during [the employee’s] 18 years of employment.” This California appellate case was decided in 1980, and the factual situation included an implied employment contract. However, the court did not hold that a covenant of good faith and fair dealing was actionable only if
an employee had an express or implied employment contract from which the covenant could arise. Rather, the appellate court found that a tort action could be maintained for breach of the covenant of good faith and fair dealing in every employment
relationship, not just those covered by an express or implied contract. The California Supreme Court subsequently rejected this formulation and eliminated the tort action.
Later, however, in Kmart Corporation v. Ponsock, the Supreme Court of Nevada permitted a cause of action in tort for breach of an implied covenant of good faith and fair dealing in every employment relationship.39 Ponsock was a tenured employee at Kmart, hired until retirement or as long as economically possible.
At trial, the jury found that Kmart terminated Ponsock to avoid having to pay him retirement benefits.
As part of his case, he claimed that Kmart’s discharge was in“bad faith” and that, even without a contract,40 such a termination gave rise to tort liability. The court agreed, citing the employer-employee relationship as one of the “rare and exceptional
cases that the duty [of law] is of such a nature as to give rise to tort liability.”41
In its opinion, the court recognized the changes that many feel have occurred in the employment relationship:
We have become a nation of employees. We are dependent upon others for our means of livelihood, and most of our people have become completely dependent upon wages. If
they lose their jobs they lose every resource except for the relief supplied by the various forms of social security. Such dependence of the mass of the people upon others for all of their income is something new in the world. For our generation, the substance of life is in another man’s hands.
The court found that Ponsock was dependent on Kmart’s commitment to extended employment and to retirement benefits based on that employment and that the “special relationships of trust” required a tort remedy in addition to any available contractual remedy if the employer conducts an “abusive and arbitrary” dismissal. Providing such a remedy, the court reasoned, would deter employers from engaging in such malicious
behavior. Because the termination in Ponsock was motivated by the company’s desire to serve its own financial ends, the employee was entitled to recover for a bad-faith agreement.

The vast majority of courts have rejected reading such an implied covenant into the employment relationship.

The reasoning used by a Florida appellate court in Catania v. Eastern Airlines, Inc., is representative. Four employees alleged that Eastern had wrongfully discharged them and claimed, among other things, that they were entitled to a good-faith review of the discharge. The court summarized the plaintiffs’ argument as follows:

According with the At Will Statute, In the United States of America, employees without a written employment contract generally can be fired for good cause, bad cause, or no cause at all; judicial exceptions to the rule seek to prevent wrongful terminations but in practice are hard to enforce by the fired employee, in struggle to survive the unexpected firing, in an environment highly influenced by the monetary power of the employer.

As was originally conceived this Statute, wrongfully assumed, that both, employers and employees, has the same bargaining power to enter into an employment agreement.

Many workers in the United States of America believe that satisfactory job performance should be rewarded with, among other benefits, job security.

However, this expectation that employees will not be fired if they perform their jobs well has eroded in recent decades in the face of an increased incidence of mass layoffs, reductions in companies’ workforces, and job turnover.

In legal terms, though, since the last half of the 19th century, employment in each of the United States has been “at will,” or terminable by either the employer or employee for any reason whatsoever. The employment-
at-will doctrine avows that, when an employee does not have a written employment contract and the term of employment is of indefinite duration, the employer can terminate the employee for good cause, bad cause, or no cause at all.

Traditionally and as recently as the early 1900s, courts viewed the relationship between employer and employee as being on equal footing in terms of bargaining power. Thus, the employment-at-will doctrine reflected the belief that people should be free to enter into employment contracts of a specified duration, but that no obligations attached to either employer or employee if a person was hired without such a contract.
Because employees were able to resign from positions they no longer cared to occupy, employers also were permitted to discharge employees at their whim.

The Industrial Revolution planted the seeds for the erosion of the employment-at-will doctrine.
When employees began forming unions, the collective bargaining agreements they subsequently negotiated with employers frequently had provisions in them that required just cause for adverse employment actions, as well as procedures for arbitrating employee grievances.

The 1960s marked the beginning of Federal legislative protections (including Title VII of the 1964 Civil Rights Act) from wrongful discharge based on race, religion, sex, age, and national origin.

These protections reflected the changing view of the relationship between employer and employee.

Rather than seeing the relationship as being on equal footing, courts and legislatures slowly began to recognize that employers frequently have structural and economic advantages when negotiating with potential or current employees.

The recognition of employment as being central to a person’s livelihood and well-being, coupled with the fear of being unable to protect a person’s livelihood from unjust termination, led to the development of common-law, or judicial, exceptions to the employment-at-will doctrine beginning in the late 1950s.

The bulk of the development of these exceptions did not take place until the 1980s, but as we enter the new millennium, the employment-at-will doctrine has been significantly eroded by statutory and common-law protections against wrongful discharge.

There are three major exceptions to the employment-at-will doctrine, as developed in common law, including recognition of these exceptions in the 50 States. These are:
1. Public-policy exception
Under the public-policy exception to employment at will, an employee is wrongfully discharged when the termination is against an explicit, well-established public policy of the State.
For example, in most States, an employer cannot terminate an employee for filing a workers’ compensation claim after being injured on the job, or for refusing to break the law at the request of the employer.

The majority view among States is that public policy may be found in either a State constitution,
Statute, or administrative rule, but some States have either restricted or expanded the doctrine beyond this bound.

The public-policy exception is the most widely accepted exception, recognized in 43 of the 50 States.

2. Implied-contract exception
The second major exception to the employment-at-will doctrine is applied when an implied contract is formed between an employer and employee, even though no express, written instrument regarding the employment relationship exists. Although employment is typically not governed by a contract, an employer may make oral or written representations to employees regarding job security or procedures that will be followed when adverse employment actions are taken. If so, these representations may create a contract for employment.
This exception is recognized in 38 of the 50 States.

3. Covenant-of-good-faith exception
Recognized by only 11 States (see map 3), the exception for a covenant of good faith and fair dealing represents the most significant departure from the traditional employment-at-will doctrine.34 Rather than narrowly prohibiting terminations based on public policy or an implied contract, this exception— at its broadest—reads a covenant of good faith and fair dealing into every employment relationship. It has been interpreted to mean either that employer personnel decisions are subject to a “just cause” standard or that terminations made in bad faith or motivated by malice are prohibited.
As with the public-policy exception, California courts were the first to recognize an implied covenant of good faith and fair dealing in the employment relationship. In Lawrence M. Cleary v. American Airlines, Inc.,36 an American Airlines employee who had worked satisfactorily for the company for 18 years was terminated without any reason given. A California appellate court held that, in virtue of the airline’s express policy of adjudicating personnel disputes and the longevity of the employee’s service, the employer could not fire the employee without good cause.
The court stated that “Termination of employment without legal cause after such a period of time offends the implied-in-law covenant of good faith and fair dealing” and that, from the covenant, “a duty arose on the part of...American Airlines…to do nothing which would deprive...the employee...of the benefits of the employment...having accrued during [the employee’s] 18 years of employment.” This California appellate case was decided in 1980, and the factual situation included an implied employment contract. However, the court did not hold that a covenant of good faith and fair dealing was actionable only if
an employee had an express or implied employment contract from which the covenant could arise. Rather, the appellate court found that a tort action could be maintained for breach of the covenant of good faith and fair dealing in every employment
relationship, not just those covered by an express or implied contract. The California Supreme Court subsequently rejected this formulation and eliminated the tort action.
Later, however, in Kmart Corporation v. Ponsock, the Supreme Court of Nevada permitted a cause of action in tort for breach of an implied covenant of good faith and fair dealing in every employment relationship.39 Ponsock was a tenured employee at Kmart, hired until retirement or as long as economically possible.
At trial, the jury found that Kmart terminated Ponsock to avoid having to pay him retirement benefits.
As part of his case, he claimed that Kmart’s discharge was in“bad faith” and that, even without a contract,40 such a termination gave rise to tort liability. The court agreed, citing the employer-employee relationship as one of the “rare and exceptional
cases that the duty [of law] is of such a nature as to give rise to tort liability.”41
In its opinion, the court recognized the changes that many feel have occurred in the employment relationship:
We have become a nation of employees. We are dependent upon others for our means of livelihood, and most of our people have become completely dependent upon wages. If
they lose their jobs they lose every resource except for the relief supplied by the various forms of social security. Such dependence of the mass of the people upon others for all of their income is something new in the world. For our generation, the substance of life is in another man’s hands.
The court found that Ponsock was dependent on Kmart’s commitment to extended employment and to retirement benefits based on that employment and that the “special relationships of trust” required a tort remedy in addition to any available contractual remedy if the employer conducts an “abusive and arbitrary” dismissal. Providing such a remedy, the court reasoned, would deter employers from engaging in such malicious
behavior. Because the termination in Ponsock was motivated by the company’s desire to serve its own financial ends, the employee was entitled to recover for a bad-faith agreement.

The vast majority of courts have rejected reading such an implied covenant into the employment relationship.

The reasoning used by a Florida appellate court in Catania v. Eastern Airlines, Inc., is representative. Four employees alleged that Eastern had wrongfully discharged them and claimed, among other things, that they were entitled to a good-faith review of the discharge. The court summarized the plaintiffs’ argument as follows:

El Dr. Mariano Inirio Sanchez, fiscal de San Pedro de Macoris por mas de 20 anos, actualmente dedicado a la practica privada, Tel. Ofic. (809)246-3216, Celular (809)962-5166, es el representante legal del Ingeniero Richard Charman en la Republica Dominicana.
Una fuente de entero credito del (CIA-CPL) "Comando Internacional de Apoyo Candidatura Presidencial Leonel" manifesto, sobre las personas anteriormente mencionadas: "El tristemente celebre Antonio Marte, lider de CONATRA, acepto poner en marcha una estratagema politica del Ing. Valgas Maldonado, con el proposito de burlar la intencion de los votantes desafectos del Partido Revolucionario Dominicano (PRD) que bien pudieran votar por su candidatura, pero que se resistian a entrar a los locales del PRD. Se decidio formar el mencionado "comando" aprovechando la posicion de liderazgo del Senor Antonio Marte, presionado por una supuesta "deuda politica" contraida con la claque del PRD durante su pasado gobierno".

Es asi como el abogado Remberto Ventura, quien se valio de una vecina de la senora Delia Gumbs para ofrecer sus servicios como administrador del apartamento ubicado en los altos del edificio, sito en la Avenida Coronel Francisco Alberto Caamano Deno #117 esquina Prolongacion Rolando Martinez, firma un “contrato de representación” con esta senora, el pasado mes de Febrero del 2007, después de comprobar que el Ingeniero Richard Charman habia rehabilitado por completo los componentes del edificio y la residencia familiar.
El abogado Ventura se identifico como Diacono de la Iglesia Catolica, pero nunca informo de su afiliacion politica con el PRD ni de su relacion con el susodicho "Movimiento".

Posteriormente indico a los propietarios del inmueble, quienes por razon de enfermedad de la senora Delia Gumbs habian retornado a Miami, que este habia sido alquilado a una persona para "una oficina de transporte", sin divulgar los fines reales.
Poco tiempo despues, el Ingeniero Richard Charman recibio informes, de parte de sus asociados en San Pedro de Macorís, de que alli se habia instalado el mencionado "Comando" y de que habian hecho cambios sustanciales a la propiedad, incluyendo pero no limitandose a: borrar'>http://s215.photobucket.com/albums/cc125/gumbsd/?action=view&current=Net-TronicsLetreroCaido-Frentede-2.jpg">borrar el letrero de la empresa Net-Tronics.com, Corporation del frente del edificio; pintar un letrero del "Movimiento" alrededor de el vuelo del edificio y posteriormente reemplazar el color naranja positivo, con que estaba recientemente pintado uniformemente el edificio, por un color amarillo canario, supuestamente representativo del "Movimiento".
Las violaciones no pararon ahi. El Ingeniero Richard Charman obtuvo fotografias que muestran como estos tenebrosos personajes habian conectado un cable desde la residencia de los propietarios, contigua al edificio, "robando'>http://s215.photobucket.com/albums/cc125/gumbsd/?action=view&current=Net-TronicsLetreroCaido-Frentede-3.jpg">"robando" la electricidad por un extenso periodo de tiempo, lo cual solo termino cuando, alarmada por los informes, la senora Delia Gumbs viajo a la Republica Dominicana, pese a su enfermedad, y el abogado Remberto Ventura "La Rata" alego que ".....los inquilinos tienen derecho a hacer los cambios que consideren de lugar" y, admitio haberles dado permiso para que se conectaran al servicio electrico de la residencia.
Este comenzo a presionar a la Sra. Gumbs para hacer ciertos cambios a la estructura interna del edificio, supuestamente por demanda de los "inquilinos", a cuyos efectos convoco a una reunion en la que participarian el, "El Vididor" y la propietaria.

El Ingeniero Richard Charman contacto a dos abogados para que acompanaran a su madre en la susodicha reunion y relevaran sumariamente al "abogado del diablo" de la administracion de la propiedad. Entre ellos figuro la hermana de un abogado amigo, quien se desempena como alguacil y quienes son tambien vecinos de las partes implicadas.

Meses despues, siguientes al retorno de la senora Delia Gumbs a Miami para seguir tratamiento por su artritis cronica, el 14 de Febrero del 2008, uno de los testaferros en Miami del Ingeniero Vargas Maldonado, conocido como Javier Herrera, co-propietario del mini-mercado "Santa Ana Market", sito en el 3000 NW 12 Avenida, de Allapatah, intento asesinar al Ingeniero Richard Charman en su residencia, segun consta en el pliego acusatorio Num. F08-005781, apuntandole con un arma de fuego al tiempo que le decia "....yo a ti te voy a joder".
La reaccion rapida del Ingeniero Richard Charman frusto el intento de asesinato y el delincuente, quien nego los hechos asi como que poseyera arma alguna, fue esposado por la policia en su negocio, en donde despues de una exhaustiva busqueda se le confiscaron una pistola y una escopeta, ademas de un revolver que ocultaba entre el asiento trasero de la camioneta de su propiedad.
Todas las armas estaban completamente cargadas “.......como si se dirigiera a una guerra” observo uno de los policias que intervino en el incidente.
Tras leersele sus derechos constitucionales el individuo fue arrestado y conducido a la carcel del condado donde paso la noche, saliendo en libertad al otro dia tras prestar una fianza.
En una vista posterior fue instruido de cargos y la fiscalia (bajo el "Plea bargain estatute") le ofrecio 3 anos de carcel, probatoria y un ano de arresto domiciliario. Bajo los consejos de su bruja, quien lo acompano a la vista, el imputado se declaro inocente y rechazo la oferta, mientras el Ingeniero Richard Charman observaba el cuadro.
Durante una vista subsiguiente, el acusado se declaro "insolvente" y le fue asignado un abogado (pro bono) pagado por el Estado.
